Speaking on TRT regarding the grievances caused by contractors in pre-payment flat sales, Av. Barış Mükyen stated: “Some contractors are unwilling to deliver flats to the buyers with whom they have entered into contracts. There are also instances where additional payments are demanded at the point of delivery. This situation results in buyers suffering significant losses.”
Underlining that buyers experience a range of grievances in pre-payment flat sales, Av. Barış Mükyen emphasised the sensitivity of the matter and the need to protect buyers. Stressing that even formal contracts fail to safeguard buyers, Mükyen elaborated as follows: “Let us suppose, for example, that the total price of a flat is 500,000 TL, and that the buyer has made an advance payment of 300,000 TL. The outstanding balance should, in principle, amount to 200,000 TL. However, the buyer may be asked for a further 500,000 TL at the point of delivery. This constitutes a serious injustice to buyers, and the matter therefore demands the utmost care and attention.”

Highlighting that certain contractors are reluctant to deliver flats to the parties with whom they have entered into agreements, Av. Barış Mükyen went on to inform the public about the hardships arising from this situation: “In pre-payment flat sales, we encounter a great many problems stemming from contractors. Some contractors, despite having received advance payments, increase the price of the flat once construction is complete — or refuse to deliver it to the person who made the advance payment. Each of these scenarios represents a serious injustice to the buyer. In some cases, we observe that even contracts prove insufficient and fail to protect buyers. I can therefore say that the measures to be taken in order to remedy the existing grievances are of the utmost importance.”

Further underlining that buyers may be required to make additional payments at the point of flat delivery, Av. Barış Mükyen concluded his remarks with the following words: “The protection of buyers is a matter of great importance to us, as we encounter contractor-related problems with considerable frequency. Buyers face serious difficulties at the point of flat delivery. Where additional payment is demanded from the buyer upon delivery and the buyer refuses to comply, the matter is referred to the courts.”
